Food safety regulator takes legal action against Nestlé India for alleged nutrition rules violation

The food regulator on Friday said that it had initiated legal action against Nestlé India after a sample of one of the company’s baby food products was found to be substandard during testing. It also flagged allegedly misleading claims on two other baby food products.

The Food Safety and Standards Authority of India said that a sample of a “follow-up formula”, a milk product for infants, was found to be “sub-standard with respect to biotin”.
The regulator also flagged two other products, NAN Excella Pro Stage 1 and Lactogen Pro 1, for making allegedly misleading claims violating the 2020 Foods for Infant Nutrition Regulations and the 1992 Infant Milk Substitutes Act.
In the case of NAN Excella Pro Stage 1, claims relating to “5 HMOs” and whey protein were observed, the food authority said. In the case of Lactogen Pro 1, a claim relating to whey protein “being easy to digest” was observed, the regulator added.
“5 HMOs” refers to a blend of five Human Milk Oligosaccharides.
While the 2020 rules restrict promotional material or claims intended to increase the saleability of infant foods, the 1992 Act bars their advertisements.
The regulator said that it had sought clarifications from Nestlé India regarding the claims.
