Death penalty off the table for Nick Reiner in parents' murder case

Prosecutors have taken the death penalty off the table in the case of Nick Reiner, who is accused of the brutal slayings of his parents, Rob Reiner and Michele Singer Reiner.
“After a careful and thorough review of all these factors, the district attorney’s office will not be seeking the death penalty in this case,” Los Angeles District Attorney Nathan Hochman told reporters, per NBC News , on Tuesday before a pretrial hearing.
“That means that the maximum sentence that Mr. Reiner will be looking at is life without the possibility of parole.”
Why was the death penalty removed?
While it’s unclear what ultimately led to prosecutors’ decision, both Rob and Michele were against the death penalty.
“We did speak with Nick Reiner’s siblings, and they made their views very clear,” Hochman said, referencing Jake and Romy Reiner.
“We took their views into consideration in ultimately deciding not to seek the death penalty.”
TMZ also pointed out that California has halted the death penalty for 737 planned executions following a 2019 order by Gov. Gavin Newsom.
While people in the state have been sentenced to death in recent years, the last person executed on death row in California was in 2006.
Charges against Nick
The 32-year-old middle son of Rob, 78, and Michele, 70, was indicted by a grand jury for their murders last December.
“This was a profound betrayal by someone who was loved and trusted by the very people he is accused of killing,” Hochman said in a statement on Aug. 12.
“The indictment unsealed today also adds a special circumstance allegation that the defendant committed the murders by means of lying in wait,” he continued. “We hope that by having a grand jury return an indictment in this case, it will bring us one step closer to a trial and achieving justice.”
It remains unclear if Nick will seek an insanity defence, though it is believed his history of drug use and related mental health disorders will play a major role in the trial and sentencing.
He previously pleaded not guilty to two counts of murder with the special circumstance allegations of multiple murders and murder by means of lying in wait after the indictment was unsealed.
Rob and Michele remembered
During the 2026 Creative Arts Emmys on Sept. 5, Rob was honoured with a posthumous Emmy for his role of Albert Schnur on The Bear .
Rob and Michele were also remembered at Monday night’s Emmy ceremony, where their friend Jamie Lee Curtis broke down in tears while paying tribute to the couple .
“Last year we lost another cherished legend: our beloved meathead, Rob Reiner,” Curtis said, while also noting his Emmy win for Guest Actor in a Comedy Series the week before.
“He now holds the record of 48 years for the longest gap between acting Emmys, which was previously held by his father Carl Reiner at 37 years,” she noted.
“He was generous and kind, and funny as hell, and a friend to all,” Curtis added. “And we all miss Rob and Michele, and all those we lost this year.”
