Man accused of 'violent' sex assault in Whitby park while under house arrest

A 33-year-old man is accused of a “violent” sexual assault of a woman in a Whitby park last week while he was under house arrest.

Durham Regional police say officers responded to Iroquois Beach Park in the area of Gordon St. and Waterfront Tr. – on the waterfront in the south end of Whitby – after receiving reports of a female who was sexually assaulted around 10:15 p.m. on July 13.
“The victim was leaving Iroquois Beach Park, walking along the sand path that runs northwest toward Gordon St., when she was assaulted by an unknown male,” police said in a statement released Friday. Police allege the man “forced the victim off the path into a treeline where he made threats and sexually assaulted her.”
“Following an extensive investigation by members of the Special Victims Unit, with the assistance of tips from the public, the suspect was identified, police said, explaining the man was taken into custody “without incident” on Thursday.
“At the time of this incident, the accused was bound by house arrest curfew conditions,” police added.
Police have not revealed why the accused was under house arrest.
Dwayne Horace Daley, 33, of Ajax, is charged with sexual assault, uttering threats, robbery and four counts of failing to comply with a release order.
He was held for a bail hearing.
